After Grotius, before Kant: the Character of Early Modern Natural Law

Le Prof. Knud Haakonssen, l'un des plus brillants spécialistes de la pensée juridique et politique au XVIIIe siècle, donnera une conférence sur la place du droit naturel dans la pensée politique des Lumières. During the seventeenth and eighteenth centuries, natural law flourished as an academic culture, and it had wide ramifications outside of the academic world. Yet natural law in this period is something of an enigma. Since the nineteenth century, philosophers have found that this form of natural law was a poor left-over from scholastic doctrine or that it was made irrelevant by the moral and political theory of Kant. But how could something of so limited value occupy some of the finest early-modern thinkers and be institutionalised as a fashionable subject in higher education across most of Europe ? The lecture will address this problem by suggesting that post-Grotian natural law cannot be studied simply as a philosophical doctrine in the modern sense.
